原标题:网红吹头发视频遭下架,起诉平台?判了9月13日,南都记者从北京市第四中级人民法院获悉,近日,北京四中院二审审结一起网络服务合同纠纷案,林某因上传的视频内容涉及低俗被下架且反复申诉无果后,将某短视频平台告上了法庭。

二 | 法院最终驳回了林某的全部请求,用有力的判决对违背公序良俗、有伤社会风化的视频内容坚决说“不”。网红发布吹头发视频平台以“涉及低俗”为由下架林某是某短视频平台的用户,经常在上面分享自己的生活片段,并逐渐积累了一定的粉丝量,成为了一名小有人气的网红。

三 | 某日,林某将自己在淋浴间吹头发的视频发布在了平台上,短时间内点击量就达到了15000次。

四 | 但是一天过后,林某却收到了“您所发布的视频涉及低俗,未通过审核,已被禁止通过”的通知,此时他才知道自己的视频已经被平台下架,而平台给出的下架理由则为“视频中赤裸上身洗浴、身披浴袍吹头发等画面涉及低俗色情,有高度疑似裸露下体的情况”。针对短视频平台的说法,林某表示自己只是身穿深色内裤,并没有裸露下体,视频平台单方停播的行为严重损害了自己的权益,要求恢复视频的播放。

五 | 视频截图。来源:北京四中院 短视频平台辩称, 其是在收到用户对该视频包含色情低俗内容的举报后,经核查情况属实采取的下架措施,均合理合规。同时,此前平台在与用户签订注册协议时, 已提前告知用户禁止发布淫秽、色情等内容,并标明了违规后的惩罚措施,在视频下架后也提供了相应的申诉和反馈渠道,以保障用户的知情权、申诉权等。因此,平台对涉案视频采取下架措施合理,且有法律、用户协议及平台规则等依据支持。法院:下架措施并无不当本案争议的焦点主要在于,视频平台对涉案视频进行下架处理是否符合网络服务合同的约定依据我国法律规定,依法成立的合同受法律保护,对当事人具有法律约束力,当事人应按照约定全面履行自己的义务,遵循诚信原则。林某通过注册、登录和使用短视频平台账号,与平台之间形成了网络服务合同法律关系,该合同系双方真实意思表示,没有违反法律法规的强制规定,应认定为该合同有效,双方均应当按照网络服务合同的约定履行各自义务。

六 | 同时,《用户服务协议》系双方网络服务合同的组成部分,其中所包含的“用户不得在平台制作、发布和传播淫秽、色情信息”“若有违反则视频平台有权独立判断并视情况立即停止传输相应信息”等内容,也应当认定为有效。视频截图。
